Terms of Service

The agreement between ESPERFEK SOFTWARE COMPANY and the delivery companies and people who use DeliveryLinker.

Last updated August 18, 2026 · DeliveryLinker is a product of ESPERFEK SOFTWARE COMPANY (“ESPERFEK”, “we”).

  1. The service. DeliveryLinker is a web and mobile software service for dispatching and tracking deliveries and for connecting delivery companies to ordering platforms such as ezCater. Delivery companies (“Tenants”) subscribe; their staff, drivers and customers use it under the Tenant's account. Using the service means you accept these terms; if you use it on behalf of a company, you confirm you may bind that company.
  2. Accounts. You are responsible for keeping your login confidential and for activity under it. Tenants are responsible for the users they create, for having the right to enter their customers' and drivers' data, and for telling those people that DeliveryLinker is used.
  3. Fees. Tenants pay ESPERFEK per completed order at the rate shown in the console (pay-as-you-go, or pre-paid order tokens purchased in bundles), invoiced or charged as agreed, exclusive of taxes. Nothing is sold inside the mobile app. Unpaid invoices may result in suspension after notice.
  4. Location data. The Driver app collects the driver's device location while on duty and shares it with the Tenant's dispatchers and, in limited form (ETA and approximate position during an active delivery), with the Tenant's customers and delivery recipients. Drivers stop sharing by going off duty. See the Privacy Policy.
  5. Third-party services. ezCater, telematics providers, mapping and geocoding providers, Google Firebase, Amazon Web Services, Stripe and the Apple App Store / Google Play; their terms apply to their portions. ESPERFEK is not affiliated with ezCater, Inc.
  6. Acceptable use. No unlawful use, no attempts to access other Tenants' data, no reverse engineering, no abusive or automated load, no use of the driver location feature to track a person who is not on duty for the Tenant.
  7. Data. Tenants own their data. ESPERFEK processes it to provide the service, keeps backups, exports a Tenant's data (CSV) on request, and deletes it within 30 days of termination on request, subject to legal retention.
  8. Availability and support. Provided “as is” and “as available”; we aim for high availability but do not guarantee uninterrupted service. Support: support page.
  9. Liability. To the extent permitted by law, ESPERFEK's aggregate liability is limited to fees paid by the Tenant in the 12 months before the claim; no indirect or consequential damages. DeliveryLinker is not a party to deliveries, driver engagements or payments between Tenants, drivers and customers, and does not provide tax, payroll or legal advice.
  10. Termination. Either party may terminate on 30 days' notice; ESPERFEK may suspend for non-payment or misuse.
  11. Changes. We may update these terms with notice in the console; continued use is acceptance.
  12. Governing law. State of Florida, USA.
